Repairs to carports

Please assist in making a decision. Our units have the exclusive use of their carports - although they are part of the common property. One owner has made a request to replace the concrete flooring. Complains that it is crumbling in sections and is not even. Who is responsible for the costs ?

Body Corporate. Should be part of your STSM maintenance plan requirements under capital items for your scheme

If owners have exclusive use of carports which are in fact unregulated common property, they should either be renting them from the BC or if there are enough of them to be fairly distributed, they should be allocated to those as EUA's. If leased the rental income would cover the maintenance and repair of them or if formal EUA's the costs of maintaining and repairing them cold be passed on to whoever has the sole use of them.

Thank you. Each unit has their own carport which is completely closed off and for their own use.

If each and every owner has a carport then it fair for the BC to maintain and repair them and as they are unregulated common property this is the correct way to treat them. Alternatively a resolution could be sought to make them official EUA's in which case each user is responsible for the costs or maintaining and repairing their own car port.
