Using a Sectional Title Unit as a hostel

Good afternoon all,
Three current sectional title owners are currently negotiating the sale of their units to a buyer who intends using them as hostels for employees. In my opinion this is not allowed and can also be contrary to Municipal By-laws.
Apart from the obvious disruption, our complex has extremely limited open parking space.

Hi Arthur,
I suggest you go to your local Town Planning officials at the local municipality and see what "overcrowding" provisions apply under the relevant Town Planning scheme.
There may also be provisions that limit the number of "lodgers" in a residential apartment.
However, there is nothing in sectional titles legislation that would allow a body corporate to interfere with the way an owner allows family, friends, visitors or paying guests/employees to use the rooms in a section.
If you are worried about parking or any other issue in regard to use of the common property, make sure that the necessary (reasonable) behavioural restraints are in your Conduct Rules and include in your Management Rules a provision allowing the scheme to impose fines (after a hearing, due process etc.) for repeated breaches of any Conduct Rule.
