Pet approval time period

By Joann Nel on Fri, 11 Jan 2019 at 10:47

Please can someone advise what the time period is for the trustees to approve a pet application for a tenant. Day 5 today and we have not had any feedback from the trustees.

Hi Joann
There is nothing in the STSM Act or Rules that requires trustees to respond to requests within a specified time. While one appreciates that obtaining certainty about one’s precious pets is very important to their owners, it is also necessary to take into account the fact that trustees are unpaid volunteers, most of whom have full time jobs, and it is not always possible for them to convene at short notice to consider your request. Unless your conduct rules contain a blanket prohibition on pets, in which case your request cannot succeed, the trustees are required to apply their minds properly to your request, taking into account all the surrounding circumstances, which may require them to revert to you to obtain further information. This is not a decision which can or should be taken without proper consideration. Having said this, the trustees cannot delay their decision unreasonably. It seems to me that a five day delay is not unreasonable, although your request should at least have been acknowledged.
If you have still not heard from them, a courteously worded reminder inquiring when you can expect a decision may prompt a response.
The following article is very informative. It refers to the Sectional Titles Act, but is still highly relevant to the STSM Act.
