Hi, may the trustees of the body corporate increase the annual levies with 60% (R972.00 - R1579.00 per month)and also add special levies for maintenance per month (R748.83)+ parking bay levy of R113.28 per month without the concent of the owner?
Please advise.

Ordinary monthly contributions may only be increased in one of two ways.
1. An interim increase of 10% maximum (PMR 31 (4A)) which is from the end of the financial year until the AGM is held. 2. At the AGM the members have to approve the estimates presented by the trustees (PMR's 36 and 56 (b)). This is the amount the trustees must use to determine the new contributions i.t.o. PMR 31 and not any amount they might wish to use....Show More
Apart from 1 above the trustees have NO authority to increase contributions.
Special levies i.t.o. PMR 31 (4) may only be raised for items not budgeted for and of an urgent nature. The amount for maintenance should be included in the normal levies and not as a separate SL. The members are also at fault if they allow estimates to be approved which are obviously not sufficient to cover the scheme's expenditure for the following year. Questions should be asked at the AGM if it is obvious that PMR 36 (2) is not complied with and the estimates should be amended – both PMR 31 (2) and 56 (b) makes provision for this.
The additional contribution i.r.o. a parking bay (if it is an EUA) is determined as per § 37 (1) (b) – only for costs directly related to the EUA and NOT to subsidise (decrease) the ordinary contributions.

EUA = Exclusive Use Area
