Satelite Dishes

By Eugene vd Merwe on Fri, 30 Jul 2010 at 08:11

Morning all.
This topic relates to the removal of unsightly DSTV Dishes.
When we purchased into our scheme, the only TV reception available to all units was through a communal SABC/ETV antenna.
We were all then allowed to install private DSTV dishes. This has lead to an unsightly situation on our roofs.
Informal discussions were held, and agreed that we need to remove these dishes, and replaced with a communal dish.
We now have a situation where the trustees have gone ahead and started removing dishes and the communal SABC antenna.
As I now understand, units will no longer have the ability to view SABC. The New Satellite Dish system will be the only option. Having said this, the new dish system will only have the ability to receive certain, and not all the channels.
Two different installers submitted quotes.
The more expensive option would have been an "upgrade" at the same time solving the "unsightly" problem.
The cheaper option is a downgrade, which forces unit owners that do not have DSTV to now upgrade without the choice of just viewing the normal SABC channels covered by their TV licence.
The questions that arises from this are as follows:-
Can the trustees just remove the SABC antenna, without BC authorisation?
Can they remove the privately owned dishes without authorisation?
Can they "downgrade" current options available on the DSTV system without authorisation?
Your input will be greatly appreciated.
Regards,
Eugene.

Hi, Eugene. From what you say, it looks as if the Trustees were being a bit high-handed here. They have no legal right to remove the dishes that have been installed by owners, without their consent. They seem to be trying to impose their will on the owners (informal discussions hold no water legally).
They are removing an improvement (the SABC aerial) without following the requirements of PMR 33.
They plan to install a new system - which rates as an improvement (whether luxurious or non-lux will be open to heated discussion!) without obtaining the BC's authority via a formal resolution (special or unanimous).
Your Trustees should carefully peruse PMR 33.
