Fines - how to on paper?

Hi! Please advise - it is states in our C/Rules (by special resolution) that Trustees may issue fines/penalties after a hearing with the transgressor by Trustees. Now - how does one "put pen to paper"? I have read and heard that one cannot do it via the levy statements. Should one have a whole different set up for issuing fines a sub-company (Body Corp) for fines? I just want my facts right. The owner we just had a meeting with has asked that his tenant be told and in writing by a Muslim elder and that he has 14days to bring himself into line and behave or fining will begin. Any opinions/advise welcomed!

Hi Shelley,

I see no reason why a correctly raised fine can't be added to the levy statement, as long as it is clearly itemised. If anybody thinks otherwise, I would like to hear the reasoning.

If fines/penalty procedures are taken up in a scheme's rules and the rule has been made according to the requirements of the STA there is nothing which would make it any different from any other debt to the BC and can be added to the monthly statement – provided it is clearly shown as a fine and not like a scheme I have heard of which adds it on to the levy (highly illegal!).
