Our Body Corporate decided to do away with the intercom system that allows the guards to let you know of a visitor here and got remote controls, which apparently each one has its own number, so should you lose it you have to apply for a new one, the problem I am having is my daughter and son-in-law live with me, so there are 3 adults living in my unit but the body corporate will only have 2 people per unit having them, they now say each time I need access to the gates, I would have to sign in and out at the guards house, which I feel is ridiculous, I am the owner of the unit, and find it to be dangerous for me to wait ouside the gate to be helped, could you please advise if they are allowed to do this.

:-) Take one remote from either of your daughter or son-in-law, and leave them with the problem you are struggling with.
Your BC must have a good reason for limiting the remotes per unit. Find out what...
With having support from owners with PQ of 25%, you may request a SGM at which to discuss and resolve this issue.

Hi, June. It sounds to me as if the Trustees (Note: not the Body Corporate) are making what amounts to a conduct rule, in making a ruling about the number of remotes allowed per unit. What do other members think?

I think I agree with Anne. Was this conduct rule filed with the Deeds Office? Maybe June should obtain a fresh copy of the conduct rules from the Deeds Office and if it is not there than it is invalid.

With all due respect, IMO this is not a "conduct" matter. The trustees are there to MANAGE the affairs and decided on the mechanism to run security.
You cannot formulate a conduct rule to state "an owner shall not apply for more than 2 remote controls to gain access to the premises." Am I being naive?
I would take this to the AGM as a special matter and (hopefully with the necessary support) instruct the trustees to revise the ruling.
Else, go the SGM route.

Just from a technical point of view, I believe your gate motor would only have one code for remote access, therefore you should be able to buy another remote at a hardware store, enter the same code as the other remotes and voila - you have access. ...Show More
In order to find out if you all have the same codes on your remotes, why don't you borrow your neighbour's remote and just see if it has the same settings as yours.

Hi, Susan. The whole idea of use of remotes is that each has a separate number. Security would be considerably diminished if the same number were to be used for everyone.

In the complex where I live we all have the same codes it might work.

Imagine everybody so to speak, taking the oppurtunity to deliberately defeat the purpose of any arrangement, especially security measures. I sincerely hope that the exterior criminal element in your environment does not pick up the same brain waive as is suggested.
One last comment - most modern remote control systems switch the setting electronically and manipulation as is intended above gets defeated....Show More

I think Gerhard may have a point there. What June maybe should consider doing is declaring a dispute in terms of PMR 71. Prof's book offers excellent advice on this. She should think of getting it.
