Noise Levels caused by TV sets and the like

Hi, what do we do with an owner who is hard of hearing and plays his TV set at extreme levels, he also has a compressor/heater/aircon which is being used at night early morning which is fine except it is causing a vibration and we cant get to sleep and when we eventually do it is waking us up in the middle of the night. We cant hear our TV programmes,and have to play our TV set at ridiculous levels to block his noise out, he lives above us and is also a member of the body corporate ( not that it means anything, we have reported this to the Supervisor who says he spoke to him)
Now in discussion and emailed the Managing Agent who says they need the vote of 3 trustees to send to the owner?
What do we do regarding listening to our TV programmes in the meantime? Its absurd that we are paying a very high rental and have to put up with this situation.

Hi, Brenda. The trustees are responsible for enforcing the conduct rules. Have you reported the matter to them?

Hi Anne, thanks for your input, problem with this complaint is that the man who is causing the noise is one of the trustees, I think what I will do if it continues is to speak to the owner of the apartment and he must resolve it with the trustees.

Take care, however, Brenda, not to cause a nuisance to other owners by speaking as loudly to the offending owner as you will have to in order to be heard. After all, he is hard of hearing. His right to hear his TV by adjusting the volume control to the required level would therefore be protected.

Hi Brenda, I think if you can approach the owner that is playing his TV that loud, as you also indicated that you are paying a high rental, so it seems that a person that can afford an expensive place would be a reasonable person and would comply with your request. You can also approach your local metro police by-law’s unit to do an assessment of the noise level.

Hi, Brenda. Do I understand from your posting that the complainer is a tenant and not the owner of the Unit?
I reiterate that you should write to the Trustees (i.e. the trustees as a whole, and not just one of them).
