Trustees failure to comply with PMR and STA
Our board of trustees comprise 8 members, of which I am one. Despite drawing their attention to the PMR and conditions of the STA, the majority of them deliberately ignore the rules and Act. What would the course of action be to enforce the compliance of PMR and STA? John Yates has referred to a direction handed down in the High Court in March 2005. It is VERY difficult, and the situation creares a lot of stress, when trustees at a meeting displays ignorance of the Act and Rules. One finds that trustees follow an interpretation that enforcing the rules leads to an injustice done to the owner against whom compliance must be enforced ("...can he carry on with the extensions to his unit in the mean time, the summer/winter is near and his wife suffers from a rash - we know that nobody will object to this application to extend his unit...")
It's enough to make me heart beat through me ears.

Gerhard is right. Even if the Trustees feel they are being helpful by bending the rules, their decisions as likely as not, will come back to bite them in years to come. Short of getting the cooperation of 25% of the owners (by value) to back you up and call a SGM with the objective of replacing the Trustees, you\'ll just need to be patient and wait for the passing of the Ombud legislation.
