Abusive Chairman

By William Haywood on Thu, 26 Aug 2010 at 09:19

What are the rules regarding a BC Chairman? How much authority does he have? In our complex the Chairman whenever approached by an owner or tenant, loses his temper and ends up swearing at whoever has approached him. He later pretends that the episode didn't happen or turns the story to suit himself. We have 27 units in total - how many would need to vote him out as Chairman?

Hi
The trustees (including the chairman) are elected by the members of the BC at the AGM. The chairman in turn is elected by the trustees (PMR 18).

The chairman has neither additional, special nor super powers (although there are unfortunately those who think they do). The ONLY "benefit" the chairman has is his casting vote at a trustees' meeting if there is a deadlock in the voting....Show More

In terms of PMR 13(e) a majority vote at a properly constituted general meeting would be sufficient to remove the individual from the office of trustee that would include his office as chairman.

On a similar note, can a Chairperson who has been voted off as chairperson only, not trustee by majority vote of Trustees, for vote of no confidence and then had resigned as trustee, be elected chairperson again when some of the Trustees have since resigned and new members come on board? Surely once you have that against you and the vote was done for a reason, shouldn't that stand?
