Proxy vote at SGM

By Lana Quinn on Fri, 27 Aug 2010 at 11:23

On a point of clarity - if a proxy is tabled at the beginning of a SGM is it invalid. Also, do PMR's allow for guidance on how a proxy may be used or must the letter of the law as stated in the Act be implemented. This was a point of tedius discussion at a recent SGM whereby a owner refuted the validity of a proxy being handed to the Chair at the beginning of the meeting.

Ha, Lana. Proxies must be handed in to the Chairman prior to the commencement of the meeting. Once the Chairman has formally opened the meeting, it's too late.
PMR 67 merely states that voting may be cast personally or by proxy - whether on a poll or by a show of hands. See PMR 67 on the Library pages of this site for the full text.
Indeed the Act should be implemented - except that is does not mention proxies (unless I've overlooked it somewhere?). The whole subject of Meetings of the Body Corporate is covered in the PMRs, and I can find no mention of it in the Act.

Many thanks - this has certainly assisted in dealing with this matter.

Hi
The proxy giver may either instruct the proxy holder on how to vote on certain issues or otherwise leave it up to the holder to vote/act as he sees fit.
