DSTV installation

By Greg Bigby on Mon, 30 Aug 2010 at 09:30

A resident (also a Trustee) in our complex, has installed a DSTV dish on the wall directly outside her unit, which is clearly visible from the main entrance. She did not advise the other trustees or request permission. Furthermore the previous chairperson had advised other residents that no dishes were to be installed anywhere but on the roof. Is she in contravention of the conduct rules (4&5). Can she be requested to remove the dish and install in the appropraite place? Please advise.

PCR 4 would seemingly apply to devices designed to protect a section from unauthorised entry.
PCR 5 provides for the trustees to consider and decide on a fitment on common property that is aesthetically displeasing or undesirable.
Therefore on the face of things, it would seem that the decission by the trustees to only allow dishes to be installed on the roof is within their power to prescribe. Accordingly the owner who installed her dish on the wall could be requested to remove it and install it as directed.

Dear Greg, if that is what you're calling yourself nowdays Swendy.
Firstly, the previous chairperson has never said that dishes were to be installed anywhere but on the roof. hw eas asked, on occassion where the best place was to put these.
Secondly, the dish in question is not clearly visible from the main entrance. It is in fact on the side of the building furtherest from the main entrance.
Thirdly, if you plan to request the dish be moved, then please also request that the two airconditioning units on the fron of the building for units No 1 and No 4 also be moved as permission to install these was never requested in terms of the Sunbury Body Corporate house rules.

That should have read Units 1 and 5, not unit 4.
