Illegal employment
According to the Private Security Industry Regulatory Authority (PSIRA), the Body Corporate is not allowed to employ a security guide without being registered as a security company and one of the trustees has to go througha Grade "B" course. Fines contravening this are R 15000.00 per trustees on time of employment.Question: As we have been made aware of this situation, some trustees are for immediate dismissal due to non compliance and impossibility to register, but what can we do, if the proposal of dismissal is outvoted by majority? This would mean that those trustees actually condone illegal employment. Who is than responsible for payment of fine and what can be done to rectify that?

IMO the PSIRA is effective on a person or organisation operating in the field of rendering a service for a fee, etc (profitable gain), which a body corporate under ths STA, is not.
It would be in the interest of a body corporate under the STA to hire an individual who is registered under PSIRA. Normal BCEA conditions would apply, but the individual employed as a security guard would have to comply with PSIRA.
