Maintenance of ground gutter
Hi
In a relatively new development the developer installed concrete gutters on the ground to route water away from the units.
These gutters have no foundation and some of them have since subsided, leaving a gap between the gutters and walls of the units. This allows water to lie up against the walls causing damp in places.
These gutters are not situated on EUA's according to the sectional plan.
Are these gutters attached to the units or are they part of the common property? And who is responsible for the maintenance and/or repair thereof?

Hi,
If these gutters are attached to the outer shell of the building, which I presume, they are on commom property and therefore maintenance and repair are the responsibility of the BC, even if the gutters were on EUAs.
