Advise Needed

I own a home in a complex of 30 units. I am also a trustee. Our managing agent informed my mother before a trustee meeting that our chairman signed a letter on behalf of the body corporate to give another trustee permission to install a jacuzzi in his backyard - this letter was submitted along with building plans to city council for approval. Managing Agent was going to bring this up at the meeting, which she didn't. At the time of the meeting I was not aware of this & was only informed by my mother after the meeting. At this meeting it was decided that this trustee would pay a R500 for illegally installing a jacuzzi & lapa style roof. As I did not know about letter that was signed at meeting I agreed that trustee should pay fine & that would be that. What - if anything - can I do about this trustee, chairman & our managing agent as I feel this was very dishonest.

If the jacuzzi was installed on common property that belongs to all owners in undivided shares, permission would be required from all owners for the installation. The trustees/chairman are not empowered to sanction the fitment unilaterally.

Hi, Vicky. I would also question why the MA informed you mother about this; where he should have communicated with you as the owner.
