deed of sale
In the deed of sale for 60 properties, a clause was included that a certain erf would be retained by the developer, and made available to the S21 company for use as a construction entrance, until 90% of the estate was developed. The Directors of the s21 have closed the entrance however the estate is only 75% developed. The developer would like approval from the Directors of the S21 Co to release them from the access obligation so they may proceed to sell the erf. Do the Directors have the power to grant this bearing in mind the clause is in each Deed of sale
