Management Agents

Minutes after a AGM meeting to newly appointed trustees with no restriction and directions imposed blame the management agent that he was responsible for non payment of two owner in the complex. What's your take on this topic.

Surely the new trustees must advise the management agent what steps to take to bring the defaulters to book.

The responsibility lies with the trustees. I am almost sure that they really don't know what the functions of the management agents are and that the management agent contract can be reviewed and changed if both parties agree to it.

The sectional title Act does not clearly define the role of the managing agent.

Look at the prescribed management rules (under Browse the library top left) - PMR 46. However, what does your scheme's agreement with the MA specify?

The trustees remain responsible for the actions of the managing agent particularly if the actions were to be incorrect.

Just as each ST Scheme is unique, so the functions of each MA will be unique to satisfy the requirements of the scheme it is contracted to. It is up to the trustees to decide on what they want the MA to do, for the regular monthly fee and what will be charged as extras. All these items must be clearly defined in the contract.
