owners responsibility

on our complex we have exclusive use areas. one unit has a section in front of the unit where soil erosion is happening. she claims its the responsibility of the b/c alone to fix and maintain this part. most of the other units have secured their own, who is responsible for this and is the b/c allowed to raise a special levy to entertain this problem, if they do it for this unit - 7 others might want the same and the b/c is not in a financial situation to do this. no maintenance is done to the buildings as well, every owner has to do its own

THe eight owners appear not to grasp the notion of own versus common property and associated collective responsibility?

If all owners experience the same erosion problem, it might be for their benefit to grasp the concept of benefits of scale when arranging for the repair - over and above the fact that the BC is responsible for the repair.

One could argue that everybody was going to pay for his own repairs in the end, so why not submit to the rule that they contribute according to the rules and have it done and dusted?...Show More

Hi, Louise. I support the two responses. Furthermore, the question should be asked as to why the trustees have allowed the BC to get into this financial situation. It looks as if no proper estimates of income and expenditure have been made, if you have no funds for maintenance. Is it possible that, in a misguided effort to keep levies low, you have under-budgeted?
